Penev LLP contributed to the edition of Getting the Deal Through – Telecoms and Media 2011

The Electronic Communications Act (ECA), promulgated in the State Gazette, issue 41 of 22 May 2007, provides the general regulatory framework regarding the management, regulation, supervision, granting and use of electronic communications networks and services, together with a number of secondary legislative acts and administrative regulations provided therein.

The ECA has implemented the 2002 European Union regulatory framework for electronic communications networks and services (Directive 2002/21/EC of the European Parliament and of the Council of 7 March 2002). Further harmonisation of the current regulatory framework with the revised European Union regulatory framework (Regulatory Framework 2009) is to be undertaken until 25 May 2011.

The state bodies competent in the electronic communications sector are the Council of Ministers, the National Radio Frequency Spectrum Council, the Minister of Transport, Information Technologies and Communications and the Communications Regulatory Commission.
